If you are in the United States on one of the following temporary visas: A, B, C, D, D, F, G, H, I, J, L, or M, you may reenter the United States after a visit of no more than THIRTY days to Canada or Mexico if you meet the following criteria:

1) If have and present a valid passport containing an Arrival/Departure Record (I-94 Card), which has not yet expired;

2) You show the visa for which the original I-94 was issued, even when the U.S. Immigration Service has authorized a change of status, (and are able to produce both the original I-94 which was issued for the visa stamp in the passport and any subsequently issued I-94's consistent with any changes of non-immigrant status and the related notices of approval); and

3) You can demonstrate that you have maintained lawful, non-immigrant status in the United States and intends to continue doing so.

Students (holding F visas) and Exchange Visitors (holding J visas) must comply with the preceding three conditions and must show a current I-20 if holding F visas or a current IAP-66 if holding a J visa. Holders of F and J visas may reenter the United States following a visit of no more than thirty days from either contiguous country (Canada or Mexico) or adjacent islands, defined as: the Bahamas, Barbados, Bermuda, the Dominican Republic, Haiti, Jamaica, Martinique, St. Pierre & Miquelon, Trinidad & Tobago, the Leeward Islands (Anguilla, Antigua, Guadeloupe, Montserrat, Nevis, St. Kitts and the British Virgin Islands), the Windward Islands (Dominica, Grenada, St. Lucia and St. Vincent) and other British, French, or Dutch Territories or possessions in, or bordering on, the Carribean sea (22 CFR 41.125 (f)(1).

This "automatic revalidation of the I-94" priviledge is not extended to aliens whose visas are annotated with 212(d)(3)(A)( ) or 212(dd)(3)(B)( ).
